When will it happen?
The Agency Works Regulations (AWR) will be in force from 1 October 2011.
Who will it affect?
AWR will affect all businesses that employ temporary staff.
What will it mean?
The new regulations will give agency workers immediate rights and additional rights after 12 weeks on assignment. Jark have steps in place which will minimise the impact of the AWR to the employer. We are taking proactive steps to make sure our clients are well prepared and informed to make sure that action is taken well ahead of the October deadline.
The immediate impact for agency workers on the 1st of October 2011 will be that employers or hirers must allow agency staff the same facilities as employed personnel.
Collective facilities access
From 1st October candidates that are already working, or start a new placement have the right to access collective facilities. These include canteens, crèche facilities, any transport services, toilets and changing area and car parking.
Access to suitable vacancies
All clients will be required to provide candidates with the details of relevant, and only relevant, job vacancies that arise. This may be on a job board, made sure to be accessible to all workers. Transfer fees will still apply.
The worker must not be subject to persecution because of rights given under the new regulation. For example the client can not terminate a worker because of fears that the worker will use the new AWR rights.
Our view
Clients have been advised for many years that segregation between employed staff and agency staff is not good practice. Here at Jark we would always advise clients to ensure all workers are treated equally when it comes to facilities and opportunities to progress.
